A Fort Wayne man who used a hidden camera to record images up the skirts of shoppers in an Indianapolis mall, some of them minors, has had his conviction on four counts of child exploitation overturned.
David Delagrange was convicted in Marion Superior Court of using a video camera mounted to his shoe Feb. 27, 2010, at Castleton Square Mall. The trial court dismissed voyeurism charges against him but not the attempted child exploitation charges.
As a result of Delagrange's case, the legislature amended the voyeurism statute to include a new crime, “public voyeurism.”
The Indiana Court of Appeals on Friday said that because the statute under which he was convicted required participation by a child, it did not apply in his case.
