Whitley County judge to hear Gingerich's juvenile murder case

WARSAW — An Indiana judge who sent a 12-year-old boy to adult court where he pleaded guilty to murder won't preside over a hearing to determine if he should be tried as a juvenile.The attorney who filed Paul Henry Gingerich's successful appeal requested a new judge. The Indianapolis Star reports Whitley County Judge James Heuer will handle the case.
Gingerich is now 15 and in juvenile prison for helping a friend kill his stepfather in 2010.
The Indiana Court of Appeals threw out his guilty plea and sentence in December and ordered the new hearing, saying a Kosciusko County judge rushed when he waived the case to adult court.
Attorney Monica Foster argued that Gingerich didn't understand the legal process or the plea bargain to which he agreed.
