INDIANAPOLIS — A court says local judges can't pick and choose which criminal records can be expunged from an individual's record under a new state law.
Alex Lucas was charged with several offenses in 2011, but some were dismissed under a plea agreement. Lucas sought to expunge his arrest records of the charges that were dismissed. The judge, however, ruled that the statute didn't apply unless all of the charges were dropped.
But the Indiana Court of Appeals ruled Tuesday that "while the statute is not a model of clarity," it was meant to apply to any dismissed charge, not just cases where all charges were dropped.
